Hunt the Chicko! — Terms of Use

These terms apply to this website (chicko.ariamax.nl), to the browser version of Hunt the Chicko! at chicko.ariamax.nl/play/ (also when installed as a web app) and to the Hunt the Chicko! Android app — together "the Game". The Game is published by Ariamax, Rijswijk, the Netherlands. By playing the Game or using this website you agree to these terms. Ariamax's general website terms and conditions apply alongside them; where the two differ, these terms prevail for the Game.

1. Who we are

2. Playing the Game

We grant you a free, personal, non-transferable licence to play the Game for your own entertainment. You need a supported browser or an Android device; the Game may not run on every device, and we may change, update or discontinue the Game or any of its features at any time. The Game is provided as it is, without warranties of any kind.

3. Free to play, with optional rewarded ads

The Game costs nothing and contains no purchases and no virtual currency. The Android app is financed by rewarded advertisements served by Google AdMob. Watching an ad is always your choice: when you are out of hearts or have used your free levels for the day, the app offers to show an ad in exchange for an in-game benefit, and you can always continue without it. A reward is granted only when Google reports that the ad was watched to the end; if no ad is available or the ad is closed early, no reward is given and the Game continues normally. The number of rewards per round and per game and the benefit each ad gives are shown in the Game and may change.

The browser version currently shows no advertising, so the ad rewards are not available there; the daily free levels apply as they are. We intend to add the same optional rewarded ads to the browser version (through Google AdSense) and will update these terms and our privacy and cookie policies before that happens.

4. Daily play allowance

The Game gives you a number of free levels each day, counted per device and reset at midnight in your local time; rewarded ads can add more levels for the day. The allowance is not a purchase or a right — it is part of how the free Game is funded — and its size may change.

5. The online leaderboard

Joining the leaderboard is optional. If you do, you provide a player name and an email address, and your best score, level and rank are shown to other players under that name (never your email address — see the privacy policy). We keep one entry per email address. The board may also contain house players operated by us to keep it lively; they compete for nothing and win nothing.

Fair play: you may submit only scores achieved by playing the Game yourself. You may not tamper with the Game, forge or replay leaderboard requests, use bots or automated tools, or choose a player name that is offensive, misleading or impersonates someone else. We may remove or correct any entry that breaks these rules or that we reasonably believe was not earned in play, and we may change, suspend or discontinue the leaderboard at any time. There are no prizes.

6. Age

The Game is a cartoon arcade game for a general audience. If you are under 16, please ask a parent or guardian before submitting a score with your email address. Children under 13 should play without joining the leaderboard.

The Game — its code, characters, artwork, sounds, music, name and logo — and the content of this website belong to Ariamax or its licensors and are protected by copyright and trademark law. You may play the Game, take screenshots and recordings of your own play for personal, non-commercial sharing, and link to this website. Any other use requires our prior written permission.

9. Third-party services

The Android app uses services provided by Google (advertising, its consent tool and Google Play) under their own terms and policies. We do not control those services and are not responsible for their availability or content. Installing the browser version as a web app uses your browser's own installation feature.

10. Liability

To the extent permitted by law, Ariamax is not liable for any indirect or consequential loss, or for any loss arising from playing or being unable to play the Game, from lost progress or leaderboard entries, or from third-party services. Nothing in these terms excludes or limits our liability for intent or gross negligence, or any liability that cannot be excluded under Dutch law. Consumers keep the rights granted to them by mandatory law.

11. Privacy

How the Game handles personal data — what stays on your device, what the leaderboard keeps, what Google collects for ads and how to control it — is described in our privacy policy and cookie policy, which form part of these terms.

12. Changes to these terms

We may update these terms from time to time. The date at the top shows the latest version; continuing to play after a change means you accept the updated terms.

13. Governing law

These terms are governed by Dutch law. Disputes are submitted to the competent court in The Hague, the Netherlands, unless mandatory law gives you the right to another court. Consumers in the European Union may also use the European Commission's online dispute resolution platform.
